NORMI™ Healthier Home Warranty
Three-Year Renewable Warranty with Annual Compliance Review
1. WARRANTY: NORMI™ warrants to customer that the indoor air environment (defined as conditioned living space as specified in the applicable NORMI™ Certificate of SanitizationSM Project) and surfaces (within the afore-referenced indoor air environment), when properly maintained in accord with the terms and conditions of this warranty by the customer in coordination with the NORMI™ servicing member, will, when measured using the proper NORMI™ approved screening techniques of NORMI™ choosing, maintain levels of mold contamination in an “expected/normal” range for the life of the warranty and, as a result of continued maintenance, will not incur microbial decal resulting from failure of the NORMI™ ongoing protocol as defined herein for the life of the warranty period.
2. WARRANTY COVERAGE: The NORMI™ Healthier Home Warranty is a three (3) year renewable warranty based on an Annual Compliance Review as defined herein. Subject to all the terms and conditions of this warranty and because the customer is a vital part of the effectiveness of this warranty, NORMI™ and the NORMI™ servicing member’s sole responsibility will be limited to advising the customer as to methods, products, and procedures required to maintain this warranty. NORMI™ will exercise professional judgment and shall have the sole option to select the best method by which to remedy or repair the affected area within a reasonable time and in cooperation with the customer.
3. WARRANTY REGISTRATION FORM: The NORMI™ Healthier Home Warranty registration and registration instructions can be obtained from the homepage at www.NORMI.org or by requesting such information from the NORMI™ servicing member who is currently servicing the warranty. The required information is obtained through the NORMI™ Certificate of Sanitization process so that registration of the warranty only requires the Project Number that has been assigned to the project (8 digits) or the NORMI™ Healthier Home Warranty number (12 digits). The warranty customer shall be defined as the occupant of the affected property.
4. CLAIM NOTIFICATION: Upon the customers awareness of any event of water damage, water leak(s) or the unlikely event of microbial growth involving any surfaces, as defined herein, the customer must report, in writing, such event by submitting a properly completed warranty claim to NORMI™ at warrantyclaim@normi.org and the NORMI™ servicing member who is servicing this warranty (secure contact information directly from the NORMI™ servicing member) within 72 hours of first becoming aware of such event. Upon notification, NORMI™ or its authorized representatives will promptly investigate the claim to determine obligations under this NORMI™ Healthier Home Warranty. The customer will be notified by certified mail of findings, and a suggested action plan for the resolution of the claim. Furthermore, the customer must take reasonable action requested by NORMI™ to immediately mitigate further damage to treated surfaces and affect any changes within his power.
5. WARRANTY EXCLUSIONS AND LIMITATIONS – Subject to following conditions, and at NORMI™ and/or the NORMI™ servicing member’s discretion, the warranty may be voided at any time. Further, this warranty does not cover, and NORMI™ will not be responsible for covering damages as a result of any of the following occurrences or neglect of the customer:
A. NON-ADHERANCE TO THE NORMI™ CERTIFICATE OF SANITIZATIONSM.
B. NON-ADHERANCE TO THE NORMI™ ANNUAL COMPLIANCE REVIEW
C. NON-ADHERANCE TO THE NORMI™ PROTECTANT MAINTENANCE SCHEDULESM
D. NON-ADHERANCE TO THE NORMI™ SANITIZATION PROTOCOLSM
E. NON-COMPLIANCE TO RECOMMENDATIONS MADE BY NORMI™ SERVICING MEMBER OR NORMI™.
F. RESIDENCE REMAINS UNOCCUPIED A SUBSTANTIAL PORTION OF THE YEAR AS DEFINED BY “OCCUPATION OF RESIDENCE”
G. KITCHEN OR BATHROOM TILE GROUT OR CAULKING AROUND TUBS/SHOWERS/SINKS OR WHERE WATER PONDS DUE TO DESIGN OR MAINTENANCE PROBLEMS.
H. A REPORTABLE EVENT OR CLAIM NOT SUBMITTED IN COMPLIANCE WITH SECTIONS 4 OR 6.
I. MISUSE, NEGLECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES.
J. CUSTOMER NEGLECT IN REGARDS TO CONTINUED MAINTENANCE.
K. ACTS OF GOD, INCLUDING FLOOD, FIRE, TORNADOES, OR OTHER VIOLENT STORMS OF CASUALTY.
L. THE USE OF OTHER CHEMICALS, PROCESSES OR CONTRACTORS OUTSIDE OF THE RECOMMENDATION OF NORMI.
6. DISPUTES AND SEVERABILITY: The customer, NORMI™, and the NORMI™ servicing member servicing the warranty specifically agree that any controversy or claim arising out of this warranty shall be settled by arbitration in the State of Louisiana administered by the American Arbitration Association under its Commercial Arbitration Rules. Judgment on any award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereby. If any part of this warranty shall be determined to be invalid, then such portion shall be deemed severed from this warranty and the remaining terms, exclusions and limitations shall apply.
7. ANNUAL COMPLIANCE REVIEW: The customer agrees to schedule an Annual Compliance Review to adjust, where necessary, such items and procedures as will keep the NORMI™ Healthier Home Warranty in effect. Should the NORMI™ servicing member determine that the NORMI™ Healthier Home Warranty is not being maintained, he may, at his discretion, terminate the warranty and refund to the customer any monies that have been paid in advance for the warranty. Products that have been purchased are non-refundable.
8. EXCLUSIVE WARRANTY: This warranty is the only warranty made to the customer. NORMI™ makes no other warranty to customer, express or implied, including without limitation any implied warranty of warrant of mechantability or fitness for a particular purpose.
9. DURATION AND TRANSFERABILITY: This NORMI™ Healthier Home Warranty is only valid during the Warranty Period. This NORMI™ Healthier Home Warranty covers the indoor living space and is transferable to any subsequent owner/occupant of said structure when, and if, that owner/occupant become the customer under the terms of this warranty.
10. APPLICABLE LAW: This NORMI™ Healthier Home Warranty gives you specific legal rights, and you may also have other rights that vary from State to State.
11. DEFINITIONS: This document contains language exclusive to NORMI™ and its members. In every case where referenced herein, these are the definitions of terms that should be applied without further need for interpretation.
a) NORMI™ servicing member—refers to the NORMI™ member who services the NORMI™ Healthier Home Warranty during the warranty period. b) “normal/expected”—this terminology is based on the EnviroScreening lab report measuring microbial growth and is the same standard used for the NORMI™ Certificate of SanitizationSM, Sanitization Protocols, and CMI/CMR/CMA training standards. c) living space—the occupied, conditioned living space excluding crawl spaces, attics, garages, and other appurtenances that are not conditioned air space. Specifically, this has reference to the living space that has been affected by the NORMI™ Sanitization Protocol. d) continued maintenance—this warranty requires a partnership between the customer and the NORMI™ servicing member because the maintenance schedule requires ongoing monitoring, application of approved products, maintenance of the air purification equipment in good working order, and lifestyle adjustments that can only be done by the customer on a regular basis and in accordance with the NORMI™ Protectant Maintenance Schedule. e) customer—the customer is the property owner who is occupying the residence during the period of the warranty in accordance with the occupation of residence clause. f) occupation of residence—the warranted residence must remain occupied at least 90% of the time for the entire year and evidence of such occupation be produced for the warranty to be valid. If the residence is occupied less than this period of the time, NORMI™ and/or the NORMI™ servicing member retains the right to void the warranty and will not be held responsible for damage that might occur during the unoccupied period. NOTE: The Healthy Home Infusion airProfile Monitor will continue to maintain humidity/temperature readings for the entire year and the information may be used for the purpose of determining anomalies. g) NORMI™ Healthier Home Warranty—refers to the requirements as delivered to the owner of the property with respect to the indoor air quality, surface protection, and lifestyle adjustments needed to validate this warranty and keep it in force. h) ongoing protocol—the products, services, and lifestyle changes needed to keep this warranty valid and as presented by the NORMI™ servicing member to the customer.
